Under Nigerian Laws, you cannot be charged for any offence that’s not clearly stated under any written Law.
This is stated in section 36(12) of the Nigerian Constitution and also in the case Of Aoko V Fagbemi Cwlr (1961) (2).
In that case, The Court held that an individual cannot be convicted for Adultery because it was not an offence in the southern part of the country where it was committed.
